Official Rules
NO PURCHASE OR PAYMENT NECESSARY.
A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.
OPEN TO LEGAL RESIDENTS OF, AND RESIDING WITHIN, THE FIFTY (50) UNITED STATES
INCLUDING THE DISTRICT OF COLUMBIA, WHO ARE, AT THE TIME OF ENTRY,
AT LEAST 18 YEARS OF AGE.
ELIGIBILITY: The 2023 CORE Pumpkin Sweepstakes (“Sweepstakes”) is offered and open only to: (a) legal residents of, and those residing within, the 50 United States and the District of Columbia, and (b) who, at the time of entry, are at least eighteen (18) years of age (an “Entrant”). Residents of Puerto Rico, and all jurisdictions other than the 50 United States or District of Columbia are ineligible to participate. Officers, directors, and employees of Muse Nutrition, LLC d/b/a CORE Foods® (“Sponsor”), Mercury Promotions & Fulfillment (“Mercury”), IKON Pass, Inc. Alterra Mountain Company, their subsidiaries, affiliates, sales representatives, advertising/promotion/web design agencies including Mercury and/or their affiliates, assigns or representatives (hereinafter referred to collectively as “Sweepstakes Entities”), and members of their household and of their immediate families, i.e., parents, children, stepchildren, spouse, siblings, “steps” of each and persons residing in the same household of such immediate family members whether related or not and all other persons or entities associated with the development, administration, promotion, execution of, or supply to this Sweepstakes are ineligible to enter or win.
SWEEPSTAKES PERIOD: The 2023 CORE Pumpkin Sweepstakes (“Sweepstakes”) starts July 15, 2023 at 12:00 A.M., Eastern Time ("ET") and ends on October 31, 2023 at 11:59:59 P.M., ET (the “Sweepstakes Period”).
HOW TO ENTER: To submit an entry in the Sweepstakes during the Sweepstakes Period (each an “Entry”; collectively “Entries”), an eligible entrant (“Entrant”) using his/her smart-phone device, tablet or computer, must access www.corefoods.com/sweeps, the Sweepstakes website (the “Website”). Then, the Entrant must follow the instructions to complete and submit the online registration form. During registration, each Entrant must provide his/her complete first name, last name, physical mailing address, email address, and daytime telephone number and confirm that he/she is eighteen (18) years of age or older for purposes of administering this Sweepstakes; and check the box agreeing to these Official Rules. Entrants, at their own option and discretion, may elect to “opt-in” to receive future marketing and promotional communications from the Sponsor.
Limit one (1) Entry per person, household, or address (physical and email) during the entire Sweepstakes Period.
Sponsor cannot guarantee this Sweepstakes will be available via all wireless carriers. Standard data plan rates may apply. Other charges may also apply. Entrants should check their mobile plan for rates and other details relating to participation in the Sweepstakes via mobile URL.
Entries not legitimately submitted in accordance with these Official Rules, in Sponsor’s sole discretion, are void. Any attempt by any Entrant to obtain more than the stated number of allowed Entries by using multiple/different email addresses, identities, registrations, and logins, cheating or fraud, through a sweepstakes club or similar entity, or any other unauthorized methods will void all of the Entrant’s Entries and such Entrant will be disqualified from the Sweepstakes. If Sponsor suspects that any Entrant has or appears to have submitted mass Entries, or Entries generated by an automated program, bot, script, robotic, macro or use of any other devices is prohibited and will result in disqualification. All Entries shall become the property of Sponsor and will not be acknowledged or returned.
Proof of entry submission is not proof of its receipt by Sponsor. Only eligible Entries received by Sponsor and/or Sponsor in accordance with the terms and conditions set forth in these Official Rules will be eligible for the Sweepstakes drawing. In the event of a dispute as to the identity of an Entrant in the Sweepstakes, the Entry will be deemed completed by the authorized account holder of the email address used to enter in the Sweepstakes. The potential Winners, defined in Rule 4, may be required to show proof of being the authorized account holder. The “authorized account holder” is the natural person assigned to an email address by an Internet service provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. All Entries will be deemed to have been made by the authorized account holder. Sweepstakes Entities are not responsible for late, lost, misdirected, incomplete, delayed, stolen, invalid, unintelligible, technically corrupted, garbled, or illegible Entries, which will be disqualified, or for any failure to capture Entries, or problems of any kind whether mechanical, human or electronic.
RANDOM DRAWING: On or about November 2, 2023, Mercury, the independent judging agency administering this Sweepstakes, will conduct a random drawing to randomly select one potential “Grand Prize” winner, one potential “First Prize” winner, and one potential “Second Prize” winner, as each of these terms are defined in Rule 5. Each prize winner (hereinafter, sometimes referred to individually as “Winner” and collectively as “Winners”) will be notified by phone or e-mail on or about the dates listed below. It is an Entrant’s responsibility to ensure that the email address and telephone number he/she has entered is current and remains current throughout the Sweepstakes Period.
PRIZES, APPROXIMATE RETAIL VALUE (“ARV”) & ODDS OF WINNING:
Grand Prize (1). The “Grand Prize” consists of all of the following items: (i) two (2) IKON Ski Passes (the “Ski Passes”) for the 2023-2024 ski season, (ii) a trip for the Grand Prize Winner and his/her guest to any IKON ski resort in the 48 contiguous United States subject to blackout dates (the “Trip”) subject to the terms set forth below, and (iii) $500.00 in ski gear issued in the form of a Visa® prepaid card (“Prepaid Card”).
The Ski Passes are valid through November 15, 2024. The Ski Passes may be used in any IKON Resort worldwide. For more information about these Ski Passes, go to https://www.ikonpass.com/en/shop-passes/ikon-pass (the “IKON Website”). Ski Passes are subject to any restrictions imposed by IKON. Usage of the Ski Passes are separate and independent from the Trip.
The Grand Prize Winner and his/her guest may select one (1) of the following IKON resorts: Big Bear Mountain Resort, Crystal Mountain, Deer Valley Resort, June Mountain, Mammoth Mountain, Palisades Tahoe, Snowshoe, Snow Valley Mountain Resort, Solitude, Steamboat, Stratton, Sugarbush or Winter Park Resort (the “Ski Location”). The Sponsor will then provide (i) round-trip coach class airfare for the Grand Prize winner and his/her guest to an airport near the Ski Location from the major U.S. airport nearest Grand Prize winner’s residence as determined by the Sponsor in its sole discretion. In addition, the Sponsor will provide three (3) days and two (2) nights hotel accommodation as selected by the Sponsor in its sole and absolute discretion, one (1) standard room (double occupancy) as determined by Sponsor. The Trip must take place during the 2023-2024 ski season but may not occur on any of the following “Blackout Dates”: December 26, 2023 – December 31, 2023, January 13, 2024 – January 14, 2024, and February 17, 2024 through February 18, 2024. All other elements of the Trip must be paid by the Grand Prize Winner and his/her guest.
All travel must be round trip. Sponsor will determine airline, itinerary, and hotel accommodations in its sole discretion. The Grand Prize Winner and his/her guest must travel on the same itinerary. If a Grand Prize Winner lives within four hundred (400) miles of the Ski Location, the Grand Prize winner and his/her guest must arrange for their own transportation to Ski Location. In such case, the Sponsor will provide the Grand Prize winner with Six Hundred Dollars ($600) in the form of a check made payable to the Grand Prize winner as reimbursement for the cost of this travel. Any difference in value will not be awarded to the Grand Prize winner. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. If the Grand Prize Winner selects a Ski Location and the Ski Location is fully booked, then the Grand Prize Winner must select another Ski Location. If the Grand Prize Winner does not select an available Ski Location, then he/she will not receive that portion of the Grand Prize and there will be no cash alternative offered.
All travel must be finalized with Sponsor a minimum of twenty-one (21) days in advance of departure and is subject to availability and Sponsor’s approval. Subject to the Blackouts and availability, all travel dates will be determined by the Sponsor, and once made may not be altered except by Sponsor. Some restrictions may apply. The Grand Prize Winner and his/her guest are responsible for all travel expenses not included herein, including but not limited to ground transportation, gratuities, meals, parking fees, in-room charges at the hotel (e.g., mini-bar, movies), telephone calls, meals, beverages, upgrades, personal incidentals, amenities and any other fees and expenses not specifically mentioned in these Official Rules. The Grand Prize Winner will be required to provide a major credit card upon hotel check-in and all in-room charges will be charged to the credit card. The Grand Prize Winner and guest are responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance.
Once the guest is selected by a Grand Prize Winner, a guest may not be substituted, except at the Sponsor’s sole discretion. The Grand Prize Winner and guest are solely responsible for obtaining any identification documents necessary for domestic travel.
Each guest of a Grand Prize Winner must be at least eighteen (18) years of age or older, unless the minor is the child/legal ward of the Grand Prize Winner. The guest or, if a minor, his/her parent/legal guardian, must sign a Liability and Publicity Release. A minor must stay in the same hotel room as his/her parent/legal guardian. If a Grand Prize Winner’s guest fails to return such documents within the date and/or time indicated within such documents, then such guest may not be allowed to participate in the Grand Prize. The Grand Prize winner will not receive any payment or other consideration if he/she elects to take the Grand Prize without a guest.
NOTE: If due to COVID-19 or other similar restrictions, a concert or series of concerts or events are canceled, delayed or an audience is not permitted in the stands to watch a concert(s) or event(s), then Sponsor may postpone and/or cancel this Sweepstakes. If this Sweepstakes is cancelled or postponed, the Sponsor may adjust the amount and type of Grand Prize to be awarded or not award a Grand Prize.
The use of a Prepaid Card constitutes the user’s acceptance of the Prepaid Card’s terms and conditions so the Grand Prize Winner should read the terms and conditions on the Prepaid Card carefully. The Prepaid Card will not be redeemed or exchanged for cash, except where required by law. The Prepaid Card will not be replaced or replenished if it lost, stolen, damaged, destroyed or used without your permission and will be voided if altered or defaced.
The ARV of the Grand Prize is $6,018.
First Prize (1). The “First Prize” consists of all of the following items: is a Chloe Kim autographed snowboard, a CORE cooler and a one-month supply of CORE bars (30 bars). The ARV of the First Prize is $1,890.
Second Prize (1). The “Second Prize” is a one year supply of CORE bars (365 bars). The ARV of the Second Prize is $1,095.
Total ARV of all prizes is $9,003.
Odds of winning a prize depend on the number of eligible Entries during the entire Sweepstakes Period.
All costs and expenses not included above, e.g., federal, state, or local taxes, are solely the responsibility of each Winner. Each is non-transferable, and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize (or a component thereof) for one of equal or greater value if the designated prize should become unavailable for any reason. Prizes cannot be transferred, substituted, or redeemed in cash except at Sponsor’s sole discretion. A Prize winner will not receive any difference between actual and ARV of the prize. No more than one (1) Grand Prize, one (1) First Prize and one (1) Second Prize will be awarded.
Limit: One (1) prize per person or household address in this Sweepstakes.
Entrants should regularly check their spam filters and email messages to ensure they do not contain any important Sweepstakes notifications. A prize Winner will be required to sign and return as set forth in the notification email, an Affidavit of Eligibility/Compliance (including Social Security Number or Tax Identification Number as required for tax reporting purposes) & Publicity/Liability Release (where permitted by law), or an alternate potential prize Winner may be selected from among all eligible entries into the Sweepstakes. Each prize Winner will receive an IRS Form 1099 in the amount of the actual value of the prize, as required by law. Sponsor reserves the right, in its sole discretion, to disqualify and randomly select an alternate potential Winner in the event that: (a) a potential Winner is unreachable; (b) a prize notification email is returned as undeliverable or is not responded to; (c) failure to provide Sponsor with satisfactory proof of age, identity and residency; (d) a potential Winner declines acceptance of a prize; or (e) if in Sponsor’s determination, a potential prize Winner has not complied with these Official Rules. All prizes will be awarded provided there are a sufficient number of eligible entries; however, Sponsor will make no more than three (3) attempts to award a prize. If after three (3) such good faith attempts, Sponsor is unable to award a prize; the prize will not be awarded.
RELEASE: By acceptance of a prize, each prize Winner releases the Sweepstakes Entities, from and against any and all liability and claims or causes of action, including, but not limited to, personal injury, death, or damage to or loss of property with respect to all aspects of this Sweepstakes, arising out of participation in this Sweepstakes or the acceptance or possession or use/misuse of a prize or any portion of a prize or activities or events that are related to a prize.
Skiing, snowboarding and other similar activities may be an inherently dangerous activity. By accepting the Grand Prize, the Grand Prize Winner and his/her guest represent and warrant that he/she is in good health and has the ability to participate in the Grand Prize without any risk to his/her health. The Grand Prize Winner and his/her guest expressly and voluntarily assume the risk of any and all injury and damage that may result from participation in the Grand Prize. The Grand Prize Winner and his/her guest understand that such risks include, but are not limited to possible serious bodily injury, partial or total disability, paralysis, death or other injuries or damages.
LIMITATION OF LIABILITY/INTERNET: Sweepstakes Entities are not responsible for interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person’s computer related to participating in the Sweepstakes. Sweepstakes Entities are not responsible for illegible, unintelligible, late, lost or stolen entries or mail or incorrect or inaccurate entry information, whether caused by Internet users or programming associated with or utilized in the Sweepstakes or by any technical, typographical or human errors that may occur in the processing of any entries in, or the administration of, this Sweepstakes. Persons found tampering with or abusing any aspect of this Sweepstakes, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. If in the judgment of Sponsor, the Sweepstakes is compromised by viruses, bugs, non-authorized human intervention or other causes which otherwise corrupt or interfere, or may corrupt or interfere, with the administration, security, fairness or intended operation of the Sweepstakes, Sponsor reserves the right, in its sole discretion to discontinue, suspend, modify or terminate the Sweepstakes and proceed in a manner it deems fair and reasonable which manner shall include the selection of a Winner(s) from among eligible entries received prior to such discontinuation, suspension, termination or modification. Any personally identifiable information collected during an entrant's participation in this Sweepstakes will be collected by Sponsor and used by Sponsor and its agents solely for purposes of the proper administration and fulfillment of the Sweepstakes as described in these Official Rules or as stated in Sponsor's Privacy Policy at www.corefoods.com/policies/privacy-policy.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. This includes but is not limited to those individuals who create a fake or fraudulent family member, friend or e-mail address as determined by the Sponsor in its sole and absolute discretion. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
SWEEPSTAKES ENTITIES MAKE NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT AS REGARDS A PRIZE OR ANY COMPONENT OF A PRIZE. IN NO EVENT SHALL SWEEPSTAKES ENTITIES BE LIABLE FOR INCIDENTIAL OR CONSEQUENTIAL DAMAGES. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OF EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES. CHECK YOUR LOCAL LAWS TO LEARN IF ANY OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY APPLY TO YOU.
PUBLICITY RIGHTS: By accepting a prize, a prize Winner agrees to allow Sponsor and/or Sponsor's designees the perpetual right to use his/her name, biographical information, photos, videos and/or likeness, and statements for promotion, trade, commercial, advertising and publicity purposes, at any time or times, in all media now known or hereafter discovered, worldwide, including but not limited to on the World Wide Web and Internet, without notice, review or approval and without additional compensation except where prohibited by law.
DISPUTES: All federal, state and local laws and regulations apply. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of New York. All disputes arising out of or connected with this Sweepstakes will be resolved individually, and without resort to class action, exclusively by the United States District Court for the Eastern District of New York or the appropriate New York State Court located in Kings County, New York. Should there be a conflict between the laws of the State of New York and any other laws, the conflict will be resolved in favor of the laws of the State of New York. All judgments or awards shall be limited to actual incurred out-of-pocket expenses (excluding attorneys' fees) associated with participation in this Sweepstakes and shall not include any indirect, punitive, incidental and/or consequential damages.
GENERAL: By participating in the Sweepstakes, entrants agree to these Official Rules and the decisions of Sponsor and Mercury, which are final and binding in all matters and all respects relating to this Sweepstakes. This Sweepstakes is void in Puerto Rico and wherever else prohibited by law. All entries and/or materials submitted become the property of Sponsor and will not be returned. Sweepstakes Entities are not responsible for any lost, late, undelivered, misdelivered or postage due mail.
